JC 여행사 여행표준약관


제1조(목적)

본 약관은 JC여행사와 여행자가 체결한 여행계약의 세부 이행 및 준수사항을 정함을 목적으로 합니다.

제 2 조 (여행사와 여행자 의무)

① 당사는 여행자에게 안전하고 만족스러운 여행서비스를 제공하기 위하여 여행알선 및 안내•운송•숙박 등 여행계획의 수립 및 실행과정에서 맡은 바 임무를 충실히 수행하여야 합니다.

② 여행자는 안전하고 즐거운 여행을 위하여 여행자간 화합도모 및 여행사의 여행질서 유지에 적극 협조하여야 합니다.

제 3 조 (약관의 효력 및 변경)

본 약관은 그 내용을 JC 여행사 사무실에 공지하고, 회사 사이트에 게시하고, 여행계약 체결 시 송부하는 E-Mail에 첨부하여 여행자에게 공지함으로써 효력을 발생합니다.

JC 여행사는 관련법을 위배하지 않는 범위에서 본 약관을 정할 수 있으며, 필요시 약관을 변경할 수 있습니다.

JC 여행사가 약관을 변경할 경우에는 동일한 방법으로 공지함으로서 그 효력이 발생합니다.

제 4 조 (약관의 적용)

본 약관에서 정하지 않은 사항은 관계법규에 의하거나, 관계법규 등에도 정함이 없는 경우 일반적인 상관례에 따릅니다.

제 5 조 (여행의 종류 및 정의)

여행의 종류 및 정의 다음과 같습니다.

1. 기획여행: 여행사가 미리 여행목적지 및 관광일정, 여행자에게 제공될 운송 및 숙식서비스 내용 (이하 ‘여행서비스’ 라 함), 여행요금을 정하여 광고 또는 기타 방법으로 여행자를 모집하여 실시하는 여행

2. 희망여행: 여행자 (개인 또는 단체) 가 희망하는 여행조건에 따라 여행사가 운송, 숙식 및 관광 등 여행에 관한 전반적인 계획을 수립하여 실시 하는 여행,

3. 여행 수속대행 (이하 ‘수속대행계약’ 이라 함): 여행사가 여행자로부터 소정의 수속대행요금을 받기로 약정하고, 여행자의 위탁에 따라 다음에 열거하는 업무 (이하 ‘수속대행업무’ 라 함) 를 대행하는 것

o 출입국 수속서류 작성, 비자 및 기타 관련업무

제 6 조 (계약의 구성)

① 여행계약은 여행계약서(붙임) 또는 여행약관•여행일정표(또는 여행 설명서)를 계약내용으로 합니다.

② 여행일정표(또는 여행설명서)에는 여행일자별 여행지와 관광내용•교통수단•쇼핑횟수•숙박장소•식사 등 여행실시일정 및 여행사 제공 서비스 내용과 여행자 유의사항이 포함되어야 합니다.

제 7 조 (특약)

여행사와 여행자는 관계법규에 위반되지 않는 범위내에서 서면으로 특약을 맺을 수 있습니다. 이 경우 표준약관과 다름을 여행사는 여행자에게 설명하여야 합니다.

제 8 조 (계약서 및 약관 등 교부 간주)

다음 각 호의 경우 여행계약서와 여행약관 및 여행일정표(또는 여행설명서)가 교부된 것으로 간주합니다.

1. 여행자가 인터넷 등 전자정보망으로 제공된 여행계약서, 약관 및 여행일정표 (또는 여행설명서) 의 내용에 동의하고 여행계약의 체결을 신청한데 대해 여행사가 전자정보망 내지 기계적 장치 등을 이용하여 여행자에게 승낙의 의사를 통지한 경우

2. 여행사가 팩시밀리 등 기계적 장치를 이용하여 제공한 여행계약서, 약관 및 여행일정표 (또는 여행설명서) 의 내용에 대하여 여행자가 동의하고 여행계약의 체결을 신청하는 서면을 송부한데 대해 여행사가 전자정보망 내지 기계적 장치 등을 이용하여 여행자에게 승낙의 의사를 통지한 경우

기타의 방법으로 여행자가 여행사가 제시한 여행내용에 동의하여, 여행금액 전액을 완납하였을 경우

제 9 조 (여행사의 책임)

여행사는 여행 출발시부터 도착시까지 여행사 본인 또는 그 고용인, 현지여행사 또는 그 고용인 등(이하 ‘사용인’이라 함)이 제2조제1항에서 규정한 여행사 임무와 관련하여 여행자에게 고의 또는 과실로 손해를 가한 경우 책임을 집니다.

제 10 조 (행사진행 사유 발생시 계약해제)

① 여행사는 최저행사인원이 충족되지 아니 하거나, 기타 여행 현지에서 진행하기 어려운 사유 발생시 여행계약을 해제하는 경우 여행출발 7일전까지 여행자에게 통지하여야 합니다.

② 여행사가 여행참가자 수 미달 및 기타 사유로 전항의 기일내 통지를 하지 아니하고 계약을 해제하는 경우 이미 지급받은 계약금 환급 외에 다음 각 목의 1의 금액을 여행자에게 배상하여야 합니다.

      가. 여행출발 1일전까지 통지시 : 여행요금의 5%

      나. 여행출발 당일 통지시 : 여행요금의 10%

제 11 조 (계약체결 거절)

여행사는 여행자에게 다음 각 호의 1에 해당하는 사유가 있을 경우에는 여행자와의 계약체결을 거절할 수 있습니다.

1. 다른 여행자에게 폐를 끼치거나 여행의 원활한 실시에 지장이 있다고 인정될 때

2. 질병 기타 사유로 여행이 어렵다고 인정될 때

3. 계약서에 명시한 최대행사인원이 초과되었을 때

4. 기타 여행사의 영업방침과 위배되는 요구 또는 그로 인한 여행사의 손해가 예상되는 경우

제 12 조 (여행 요금)

① 여행계약서의 여행요금에는 다음 각 호가 포함됩니다. 다만, 희망여행은 당사자간 합의에 따릅니다.

      1. 항공기, 선박, 철도 등 이용운송기관의 운임 (계약 체결 시 운임기준)

      2. 공항, 역, 부두와 호텔사이 등 송영버스요금

      3. 숙박요금 및 식사요금

      4. 안내자 경비

      5. 여행 중 필요한 각종 세금

      6. 국내외 공항•항만세

      7. 관광진흥개발기금

      8. 선택관광을 제외한 일정표 내 관광지 입장료

      9. 기타 개별계약에 따른 비용

② 여행자는 계약체결시 계약금(서로 합의한 금액)을 여행사에게 지급하여야 하며, 계약금은 여행요금 또는 손해배상액의 전부 또는 일부로 취급합니다.

③ 여행자는 제1항의 여행요금 중 계약금을 제외한 잔금을 여행사가 행사진행에 필요한 잔금 지불 기일전까지 여행사에게 지급하여야 합니다.

④ 여행자는 제1항의 여행요금을 당사자가 약정한 바에 따라 카드, 계좌이체 또는 무통장입금 등의 방법으로 지급하여야 합니다.

⑤ 희망여행요금에 여행자 보험료가 포함되는 경우 여행사는 보험회사명, 보상내용 등을 여행자에게 설명하여야 합니다.

제 13 조 (요금등의 반환)

여행사는 여행요금의 과납 또는 오납이 있을시 그 과납 또는 오납된 요금은 반환하고, 여행사의 귀책사유로 발생한 경우에는 법정 이율로써 적정이자를 함께 반환한다.

여행요금을 선불로 지급한 경우 여행자는 적절한 절차에 의해 선불요금의 반환을 요청할 수 있습니다. 이런 경우 여행사는 운송수단 (항공/지상교통 등), 숙박업소 및 기타 부가서비스 업체에서 부과하는 페널티를 제외한 금액을 여행자가 반환을 요청한 시점으로부터 익월 말까지 여행자가 결제한 은행계좌로 반환 금액을 반환한다.

핸드폰과 신용카드 결제인 경우 결제후 요금을 납부한 후 환불이 가능하며 미납상태에서는 환불이 불가능합니다.

제 14 조 (손해배상 및 면책)

여행사의 귀책사유로 여행자가 서비스를 이용하지 못한 경우에는 여행사가 여행자에게 손해를 배상합니다.

손해 배상의 방법 및 절차등은 관계법령 및 일반적인 상관례에 따릅니다.

여행사는 그 손해가 천재지변 또는 이에 준하는 불가항력이거나 여행자의 고의 또는 과실로 인하여 발생한 경우 손해배상에 관한 책임이 면제됩니다.

여행사는 무료로 제공하는 서비스에 대하여 여행사의 귀책사유로 여행자에게 서비스를 제공하지 못하는 경우 책임을 면합니다.

여행자는 항공기, 기차, 선박 등 교통기관의 연발착 또는 교통체증 등으로 인하여 여행자가 입은 손해에 대하여는 그 운송주체인 운송회사를 상대로 배상 요청을 하여야 합니다. 다만, 여행사의 고의 또는 과실이 입증된 경우에는 여행사를 상대로 배상요청을 할 수 있습니다. (통상 현지업체나 현지 교통상황으로 인한 지연 및 취소의 경우 여행사는 손해를 배상할 책임이 없습니다).

여행자는 수하물 멸실, 훼손 또는 연착으로 인해 손해배상을 요청할 경우, 그 운송 주체인 여행자 자신이나 운송주체 회사에 손해배상을 요청하여야 하며, 이럴 경우 여행사는 책임이 면제됩니다.

제 15 조 (여행출발 후 계약해지)

여행사 또는 여행자는 여행출발 후 부득이한 사유가 있는 경우 이 계약을 해지할 수 있습니다. 단, 이로 인하여 상대방이 입은 손해를 배상하여야 합니다.

계약이 해지된 경우 여행사의 귀책사유가 발생하지 않는한 여행자는 귀가하는데 필요한 사항 및 비용은 여행자가 부담합니다.

제 16 조 (여행의 시작과 종료)

여행의 시작은 출발하는 시점부터 시작하며 여행일정이 종료되어 최종목적지에 도착함과 동시에 종료합니다. 다만, 계약 및 일정을 변경할 때에는 예외로 합니다.

제 17 조 (보험 가입등)

여행사는 여행과 관련하여 여행자에게 손해가 발생한 경우 여행자에게 보험금을 지급하기 위한 적절한 수준의 보험에 가입하고 유지하여야 한다.

제 18 조 (손해배상 및 )

여행사와 여행자는 서비스와 관련하여 분쟁이 있을 경우 신속하고 효과적인 분쟁해결을 위하여 여행자에게 손해를 배상합니다.

회사는 그 손해가 천재지변 또는 이에 준하는 불가항력이거나 고객의 고의 또는 과실로 인하여 발생한 경우 손해배상에 관한 책임이 면제됩니다.

손해 배상의 방법 및 절차등은 관계법령 및 일반적인 상관례에 따릅니다.

제 19 조 (분쟁조정)

여행사와 여행자는 분쟁이 있을 경우 신속하고 효과적인 분쟁해결을 위하여 서로 노력하며, 분쟁에 대한 소송이 제기될 경우 여행사의 본사 소재지 법원을 관할법원으로 합니다. (끝)




JC Travel STANDARD TERMS AND CONDITIONS


By doing business with JC Travel, Inc. (hereinafter JC), you hereby agree and consent to all the following terms and conditions:

REFUNDS AND PENALTIES: We regret that no refund can be made for absences from a tour, including but not limited to, missed meals or sightseeing. JC makes no representations or guarantees concerning reimbursements of funds paid by you under any insurance claim. Please consult JC for its reimbursement policy on cancellation of tours prior to commencement of a tour.

RIGHT TO CHANGE PRICING, SCHEDULING AND ACCOMODATIONS: JC will take all benefits and all losses of all fluctuations in price and value of airfares, cruise fares, currencies, park fees, hotels, taxes, or fuel surcharges after we have received full payment from you. We reserve the right to correct promotional, pricing errors, and/or increase the tour price in the event of cost increases due to changes in airfares, cruise fares, currency price fluctuations, park fee increases, taxes hotel prices, or fuel surcharges before we receive your reservation deposit. All prices, tariffs, itineraries, and schedules provided by JC are subject to change without notice. The JC reserves the right to cancel or reschedule any tour departures in accordance with operating requirements or circumstances beyond its control. In addition, JC reserves the right to change hotel accommodations before or during any of its tour programs. In the event of any hotel changes, the JC will provide, if possible, comparable or better hotel accommodations. If accommodations are of a lesser quality based on independent agency's rating of hotels, the JC will refund any difference in hotel tariff paid by JC for the substitute accommodations to the passenger after the completion of the tour. The price difference will not be the retail price difference, but the difference in wholesale price the JC receives as a large volume provider of travel services. Tour prices are based on wholesale costs, charges, tariffs, rates, prices, taxes, levies, and currency exchange rates. Should any of the costs change, a surcharge may be made on the price of your vacation. Due to contractual requirements, JC is not able to provide you with a breakdown of the cost for each individual component of your purchases if the total package charge has been charged as one amount.

RIGHT TO CHANGE TOUR DEPARTURE DATE: JC reserves the right to cancel or reschedule any tour departure. If cancellation is made prior to departure of the tour, the only responsibility of JC will be to refund to the passenger the amount JC received for the tour reservation. JC will try to re-book the same tour with a different departure date, or a similar tour. Where JC has confirmed flights, we will try to confirm air seats for the selected new dates, subject to availability. JC cannot assume responsibility for any additional costs or fees relating to the issuance and/or cancellation of air tickets or other travel arrangements not made through JC.

AIR TRAVEL: Any and all airline tickets purchased through JC serve as a contract between the airline and the passenger. JC cannot and shall not be held liable for any harm caused to customers by any of the airlines, moreover, you hereby agree not to hold JC liable for such damages. Please be sure to carefully check the international and domestic air tickets you purchase so that you are fully aware of the respective Airlines' policies.

BAGGAGE/LOST OR STOLEN ITEMS: JC is not responsible for lost or stolen luggage or other items and you agree not to hold JC liable for such lost items. You are responsible for checking and complying with all airline and transportation requirements for your luggage. When on tour, please do not leave your possessions unattended at any time. Remember coats, umbrellas, cameras, handbags, wallets, traveling bags, binoculars, and similar items remain, at all times, under your custody and control.

TRAVEL DOCUMENTS: Each participant is responsible for obtaining required travel documents, such as Passports, Visas, etc. Please check with the destination country's local consulate if you have any questions. Government issued photo ID is required at airports and hotels and may be required by other travel suppliers.

MINORS: All persons under 18 years of age must be traveling with a parent or appointed guardian or must obtain signed permission of a responsible adult to travel alone. JC may refuse, in its sole discretion, to allow anyone under age 18 to travel without a parent or appointed guardian. JC is not responsible for conduct of minors in any manner whatsoever. In addition, due to heightened security, many countries have adopted practices to prevent international abduction of children. If a child will be traveling with adults other than the parents or with only one parent it is recommended that a notarized letter be written by the parents or non-travelling parent granting authorization to travel, including the dates of travel. We suggest you also contact the appropriate consulate and airlines because they may have additional requirements.

NOT INCLUDED IN COST/ADDITIONAL SERVICE CHARGE: Passport and visa fees and items of a personal nature. i.e., room service, airline luggage fees, telephone calls, laundry, liquor, and all items and services not indicated as included such as optional tours activities. shall incur an additional fee or service charge. In addition, you may be required to pay a daily mandatory service charge to a tour guide. Please check with JC regarding your specific tour to determine what the daily service charge will be.

RESPONSIBILTY: JC may be acting as an intermediary and agent for suppliers in selling and booking travel services which are not directly supplied by this travel agency (such as air carriage, lodging accommodations, ground transportation, meals, tours, cruises, tour guide services. etc). JC, therefore, shall not be responsible for breach of contract or any intentional or careless actions, errors or omissions on part of such suppliers which result in any lags, damage, delay or injury to you or your travel companions or group members. JC shall not be responsible for any injuries, damage or losses caused to any travel in connection with weather, terrorist activities, social or labor unrest and mechanical or construction conditions or developments, or any other actions, errors, omissions or conditions outside the JC's control. By embarking upon such travel, you the traveler voluntarily agree to assume all risk. involved in such travel, whether expected or unexpected. The traveler is hereby warned of such risk and is advised to obtain appropriate insurance coverage against such risk. Your retention of tickets, reservations or bookings after issuance shall constitute consent to the above, and an agreement of our duty to convey the contents hereto to your travel companions or group members. The right is reserved to decline to accept or retain any person as a member of any tour as circumstances may demand it. Baggage is carried at the owner's risk and baggage insurance is recommended. The issuance and acceptance of any bookings with JC shall be deemed to be your consent to the above conditions.

TOUR GUIDES: Tour Guides may not be employees of JC but may be independent contractors. JC is not responsible for any unauthorized activities. JC takes the misconduct of tour guides very seriously and requests that you immediately inform JC of any complaints with respect to any tour guide.

CUSTOMER CONDUCT: For the benefit of everyone on your vacation JC reserves the right to accept or reject any person as a tour participant and to remove from the tour any participant whose conduct is deemed detrimental to the safety or reasonable enjoyment of the other participants on a particular tour.

HOLIDAYS: During international or national holidays, certain facilities such as museums and restaurants, sightseeing tours and activities, and shopping may be limited or not available. Alternatives will be offered wherever possible.

SPECIAL REQUIREMENTS: Passengers with disabilities are welcome on JC's tours provided that they are accompanied by a companion capable of providing all assistance required, and do not require special assistance from JC' s personnel and/or independent contractor tour guides. JC reserves the right to refuse to carry anyone it felt cannot cope with the requirements of lay travel who may require services and facilities that JC cannot guarantee will be available. You agree to NOT hold JC responsible for any decision made by JC, its employees or affiliates. In addition, You the traveler are responsible for (1) advising JC in writing in advance of any special requirements you may have and (2) advising your JC in writing in advance of medical conditions that may in any way affect your ability or the ability of any member of your traveling party to undertake the travel arrangements that you have purchased. In addition, you must provide JC a letter from your personal physician stating the nature of the medical condition and certifying that you are physically fit to undertake the travel services as purchased. Without such written notice, JC accepts no responsibility for special requirements NOT provided. Some travel itineraries offered by JC may require you to undertake medical examinations. You may also be required to show these documents to certain travel suppliers.

INSURANCE: Baggage, health, and trip cancellation insurance must be purchased by you through your own insurance agent and is strongly recommended.

DISPUTES: If you have a dispute with JC, you are encouraged to discuss it with JC in order to attempt to resolve it.

HAZARDOUS CONDITIONS: JC has no special knowledge of and shall not be held liable for hazardous conditions at destinations, including, but not limited to, weather hazards, health hazards, unsafe conditions, suppliers bankruptcies or the suitability for disabled persons during any portion of the tour. For information regarding possible dangers at international destinations (outside of the U.S.) you may contact the Travel Advisory Section of the U.S. State Department (202)647-5225, or visit the State Department's online travel advisory service at http://travelstate.gov/travel/warnignstarnl. For medical information, call the U.S. Centers for Disease Control, (404)332-4559 or on the web at www.cdc.gov/travel.

LIMITATIONS ON LIABILITY AND NOTICE OF CLAIMS: JC makes no representations or warranties other than those contained expressly in any agreement with you. Neither any advertising, circulars, other information nor statements you may receive shall constitute any such representation or warranty. There are no implied warranties or guarantees of any kind. Except where prohibited by law, JC's liability to you for any reason whatsoever, including personal injury, death, or other loss is strictly limited to the amount you paid for the tour. All disputes between customer and JC, which are not resolved directly with the JC or through its 3rd party service provider, shall be resolved by mediation. Mediation fees, if any, shall be divided equally among the parties involved. If the attempt to resolve the dispute by mediation fails, then JC and Customer, you, agree to do binding arbitration before a single neutral arbitrator pursuant to the rules of ADR Services. Inc. in Atlanta, Georgia. Arbitration fees shall be divided equally among the parties. Any award issued in such arbitration may be confirmed in any court of competent jurisdiction. In order that JC has an opportunity to accurately and fairly investigate any claim, except where prohibited by law, as a condition precedent to any arbitration or other action on any claim, you must give notice to JC in writing of such claim within thirty (30) days of any injury or loss or you waive such clam. Further, you must wait an additional thirty (30) days before demanding arbitration or instituting any other proceeding on such claim to allow JC to investigate and respond.
